Recent Bad Weather - Notifications and Remedies

Joint Contracts Tribunal (JCT) and Scottish Building Contracts Committee (SBCC) distinguish “exceptionally adverse weather conditions” as NOT necessarily a Relevant Matter. However, whilst no loss and/ or expense may prevail, you must maintain full records of any weather related detriment to production as these may result in further time being awarded.

National Engineering Council (NEC 3) contracts contain more specifics and include the poor weather as a Compensation Event if so recorded at the place stated within the Contract Data. The key factor here is not to be late with any Notices……Your NEC 3 contract contains specific time period by which you must notify the Project Manager of delays or effects of weather related events. Your contract may have been amended to reflect shorter notice periods so BEWARE as any late notification (s) will be rendered useless unless they are delivered in a timely manner.
