Med-Arb is a process whereby the parties participate
in mediation on the understanding that the process can
become an arbitration if no settlement is reached during
the course of that mediation. The Mediator and Arbitrator
can be different individuals or the same person.
The perceived wisdom underlying Med-Arb is that the
threat of formal arbitration proceedings will encourage
the parties to reach their own settlement without recourse
to arbitration. If that cannot be achieved the subsequent
arbitrator’s award will be binding.
