Kerrigans recently acted for a North West based asbestos contractor who had been employed as a subcontractor to undertake asbestos removal works for a main contractor on a high-profile city centre project in Liverpool.
The sub-contractor had undertaken almost £500,000 of work when the main contractor imposed contra-charges in relation to alleged delays for which the main contractor contended the subcontractor was responsible.
The contra-charges imposed by the main contractor exceeded the value of the works undertaken by the subcontractor. Kerrigans worked with the subcontractor to produce the notice of adjudication and the referral, and adjudication proceedings were commenced. During the adjudication, the main contractor actually increased the amount of the contra-charges to a sum in excess of £1.4 million.
Kerrigans is pleased to announce that the adjudicator in that matter found in favour of our client in deciding that the subcontractor was entitled to its full claim and in dismissing the main contractor’s contra-charges in their entirety.
